TERMS AND CONDITIONS

Pricing: This list precedes all previous quotations. Prices prevailing at time of shipment will apply on all merchandise. All orders are subject to acceptance by Leaderboard Golf™ and no orders are subject to change or be canceled without Leaderboard's® prior consent.

Damage or Loss: If loss or damage is incurred or suspected, retain the merchandise and packing materials and notify the shipper or carrier at once. Tittle to goods passes to buyer upon receipt from Leaderboard® to carrier or shipper.

Shipping: All prices are FOB Memphis, or other shipping point if merchandise is drop shipped. Leaderboard Golf™ assumes no liability for delays in or failure to make delivery due to conditions over which Leaderboard Golf™ has no control; including inability to obtain supplies, raw materials and labor, or delays of carrier, accidents, strikes or other unavoidable causes.

Ordering: Order can be faxed, toll free 1-800-489-9899, E-mailed, lbgolf@leaderboardgolf.com or called in toll free 1-800-489-9898. Orders for next day or 2nd day deliver must be placed before 10:00 AM central time. We understand how important it is for you to receive your order on a timely basis and we will do our best to give you the fast efficient service that you deserve and expect.

All orders must include your customer name and customer number. Next, you must give the product code number and descriptions.

Take time to write out your order before you call. It take much less time to place the order and the possibility of receiving the wrong product are greatly reduced.
After your order is entered into our computer program, the order will be read back to you, giving you the product code numbers, the product description and the price. If you agree that the order is correct we then ask that you verify this with your birth date. This method has been in place for a couple of years and works extremely well. The only thing worse than not shipping your order is shipping you a wrong product.

Adding or changing order: Once you place an order and verify the order with your birth date, we thank you for your business and hit OK on the computer. The order prints out in our warehouse. At this time you cannot call and change the order. If you cancel the order after it has been pulled, you will be charge a 15% restocking fee . If you need to order additional merchandise, place another order. We will try to get it shipped with the original order but we will not guarantee this. If you discover that you have ordered the wrong product, call us, if your order has not been invoiced, we will pull the order from the shipping department, make the changes, move it to the end of the line and charge a Price $ 5.00 service charge.

Minimum Orders: Any order totaling less than Price $ 25.00 will be billed a Price $ 5.00 minimum service and handling fee. All net terms customer accounts not current shall be subject to this service charge.

Terms of Payment: Prepayment of orders are accepted with: Discover, MasterCard, Visa, or C.O.D.
Qualified Open Accounts will have terms of Net 10 days. If you are a new customer and want to be shipped C.O.D. the first three orders you place with us must be by certified funds or money orders only please.

Returned checks will be assessed a Price $ 25.00 Service Charge.

Returned Goods: No goods will be accepted without using Leaderboard's® return label. Returns will be accepted for inspection only and will be replaced or credited at Leaderboard's® option. All returns must be made within 30 days of the invoice date and product must be resaleable. Absolutely no cash refunds are allowed. Please do not make return requests for closeout items.

AND NOW THE FINE PRINT: Customer are entitled to the manufacturer's limited warranty, if any. Leaderboard Golf™ makes no additional or independent warranty. All other warranties, expressed or implied, including the warranties of merchant ability and fitness for particular purpose are disclaimed. Leaderboard Golf™ will not, under any circumstances, be liable for special, incidental or consequential damages, including loss of profit, even if it has been advised of the possibility of such damages, the maximum liability for all direct damages, if any, arising from any action shall be limited to an amount not to exceed the purchase price of the product.
